Na qualidade de requerente, a Autoridade Central intervém:

• a pedido de titular de direito de guarda ou de visita cujo respectivo direito deva ser restabelecido ou executado;
• a pedido de terceiro, instituição ou organismo que julgue ter sido violado ou restringido um direito de guarda ou de visita.

A sua intervenção traduz-se:

• no pedido de regresso a Portugal da criança ou jovem que tenha sido deslocada para o estrangeiro ou aí retida sem o consentimento ou conhecimento do(s) titular(es) do direito de guarda.
• no pedido de execução ou reorganização do direito de visita no Estado em que a criança ou jovem se encontre a residir.

TRAMITAÇÃO DO PROCEDIMENTO

Se residir em Portugal e desejar solicitar o regresso de criança/jovem deslocada ou retida, ilicitamente, no estrangeiro, ou a protecção do seu direito de visita sobre criança/jovem residente no estrangeiro, poderá contactar a a Autoridade Central da Direcção-Geral de Reinserção Social que lhe prestará os esclarecimentos e o auxílio necessários para instruir o requerimento a enviar à Autoridade Central estrangeira

Em caso de insuficiência económica, o(s) titular(es) do direito de guarda ou visita poderão requerer o benefício da protecção jurídica.

As requesting Central Authority

Acting as the requesting Central Authority, intervenes as follows: ·         On request of the holder of custody or access rights, whose respective rights need to be reinstated or enforced. ·         On request of any person, institution or other body claiming that custody or access rights have been restricted or breached. The intervention translates into: ·         Application for the return to Portugal of children or young persons who have been removed or retained without the consent or knowledge of the holder of custody or access rights. ·         Application for the enforcement or reorganization of access rights in the State where the child or young person is residing. PROCEDURE                   If you live in Portugal and want to request the return of children / young persons displaced or retained illegally abroad, or the protection of rights of access of children / young persons residing abroad, you may contact the Portuguese Central Authority of the Directorate-General of Social Reintegration which will provide clarification and the necessary assistance to instruct the application to be sent to the foreign Central Authority. If legal aid is needed, the holder(s) of custody / access rights may require the benefit of legal aid. The holder should contact the competent authorities of the State of his residence.
